Terms of Service

1. Parties and acceptance
These terms govern the use of the NuvaMed platform (nuvamed.cl), operated by NuvaMed SpA ("NuvaMed", "we"), RUT 77.XXX.XXX-X, domiciled in Chile. By registering for or using NuvaMed, you ("the user") accept these terms.
2. Service description
NuvaMed is an electronic clinical records platform specialized in psychiatry, which includes:
- Clinical record and progress note management
- Automatic generation of legal documents (prescriptions, epicrisis, certificates, transfer forms)
- Regulatory compliance (GES/AUGE, Ley 21.331, Ley 20.584, Ley 21.719)
- Scheduling and appointment management
- Telemedicine via Zoom integration
- Patient wellness portal (NuvaMed+)
- Inter-professional communication network (CareLink)
- AI-powered clinical assistance
- Billing and electronic tax documents
3. Registration and accounts
- The user must be a licensed healthcare professional or authorized staff of a healthcare institution
- Registration information must be accurate and up to date
- The user is responsible for the security of their access credentials
- Each account is personal and non-transferable
- Non-clinical staff access (secretaries) is limited to administrative functions
4. Plans and billing
- Free trial: 30 days with full access. No payment method required
- Inicial plan: 1 UF/month — basic clinical documentation and scheduling
- Profesional plan: 3.5 UF/month — clinical AI, telemedicine, and billing
- Profesional Plus plan: 6 UF/month — AI copilot and advanced analytics
- Clínica plan: from 12 UF/month — multiple professionals
- Empresa plan: custom pricing — hospitals and health networks
Launch promotion: The Profesional and Profesional Plus plans include a 30% discount for the first 3 months of paid subscription (Profesional: 2.45 UF/month; Profesional Plus: 4.2 UF/month). The discount is applied automatically upon subscription and requires no code. After the promotional period, regular pricing applies.
Prices are expressed in Unidades de Fomento (UF) and converted to Chilean pesos (CLP) at the value on the billing date. Billing is processed monthly through Flow.cl. A boleta or electronic invoice is issued as applicable.
5. User obligations
- Use the platform in accordance with current Chilean legislation and professional ethics
- Maintain the confidentiality of patient clinical data
- Not share access credentials with third parties
- Obtain patient consent when required by law
- Not attempt to access data belonging to other professionals or institutions
- Immediately report any security incident or unauthorized access
6. NuvaMed obligations
- Maintain service availability with a monthly SLA of 99.5%
- Protect data in accordance with Ley 21.719 and industry security standards
- Perform automatic daily backups with point-in-time recovery (PITR)
- Notify security breaches within 72 hours
- Maintain immutable audit logs for clinical data access
- Not access clinical data except for authorized technical support with audit logging
7. Third-party integrations
Zoom: Zoom integration is optional and requires the professional to connect their own Zoom account. NuvaMed acts as a technical intermediary. Use of Zoom is subject to Zoom's Terms of Service.
Google: Google sign-in and AI features (Gemini) are subject to Google's Terms of Service.
8. Intellectual property
- NuvaMed is owned by NuvaMed SpA. All rights reserved
- Clinical data entered is owned by the patient and the treating professional, pursuant to Ley 20.584
- The user retains all rights to the clinical content they enter
- NuvaMed does not use clinical data to train AI models or for purposes other than providing the service
9. Clinical records and retention
Pursuant to Ley 20.584 Art. 12-13 and DS 41/2012:
- Clinical records are kept for a minimum of 15 years from the last entry
- Clinical notes have a 12-hour editing window; after that, corrections are recorded as immutable addendums
- All access and modifications are recorded in the audit log
- Patient deletion is logical (soft-delete) — clinical data is preserved as required by law
10. Limitation of liability
- NuvaMed is a support tool. Clinical decisions are the sole responsibility of the treating professional
- AI-generated suggestions are advisory and do not constitute medical recommendations
- NuvaMed is not a crisis intervention service and does not replace in-person care
- Our liability is limited to the amount paid by the user in the last 12 months
11. Suspension and termination
- The user may cancel their account at any time from settings
- NuvaMed may suspend accounts that violate these terms, with 15 days' prior notice except in cases of security risk
- Upon termination, the user may export their data in a structured format (right to portability, Ley 21.719)
- Clinical data is retained in accordance with legal deadlines, even after termination
12. Modifications
NuvaMed may modify these terms with at least 30 days' notice. Changes will be communicated through the platform. Continued use after notification constitutes acceptance of the new terms.
13. Governing law and jurisdiction
These terms are governed by the laws of the Republic of Chile. Any dispute shall be resolved by the ordinary courts of Santiago, Chile.
